By accessing or using the Tools for the Tough Days platform (the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Platform.
These Terms apply to all users of the Platform, including individual subscribers and business subscribers.
Tools for the Tough Days is operated by Nic Marcon (ABN 69 142 299 250), a Registered Psychologist with the Psychology Board of Australia (AHPRA).
The Platform provides access to clinically reviewed psychoeducational resources including written materials and audio content covering topics such as stress, anxiety, relationships, sleep, self-esteem, and workplace wellbeing.
All resources on the Platform have been clinically authored and reviewed by Nic Marcon personally before publication.
The Platform provides general psychoeducational information only. It is not a substitute for individual psychological assessment, diagnosis, or treatment by a registered health professional.
The resources available on this Platform are educational in nature. They are designed to support general mental health and wellbeing, not to treat, diagnose, or manage specific clinical conditions.

Use of the Platform does not create a therapeutic or professional relationship between you and Nic Marcon.
Tools for the Tough Days offers an in-house counselling service that is separate from Platform access. The two services are distinct:
Counselling services are delivered by Nic Marcon, Registered Psychologist, and any contracted practitioners whose engagement is approved and clinically supervised in accordance with applicable professional standards.

Individual employee data is never shared with your employer.
Business subscribers receive anonymised, aggregate reports showing workforce-level wellbeing trends only. No individual can be identified from these reports. Any metric derived from fewer than five responses is suppressed to prevent re-identification. This rule is stated explicitly in every business report.
All personal data is stored securely in Microsoft Azure. We apply industry-standard security practices to protect your information from unauthorised access, loss, or disclosure.
You may request deletion of your personal data at any time by contacting us at tttd@emotionalbalance.com.au. We will process deletion requests within 30 days, subject to any legal retention obligations.
If you cancel your subscription or deactivate your account, your data is retained for 90 days before permanent deletion, unless you request earlier deletion.
Your data may be processed by third-party services we use to operate the Platform, including Microsoft Azure (data storage), Stripe (payment processing), Vision6 (email communications), Microsoft Bookings (appointment scheduling), OneSignal (push notifications), and Google Analytics (usage analytics). Each of these services processes data in accordance with their own privacy policies.

Access to the Platform for individuals is available on a monthly subscription basis at the price displayed at the time of purchase. Subscriptions renew automatically each month unless cancelled.
Business subscriptions are available to organisations wishing to provide platform access to their employees. Business pricing is displayed on our For Workplaces page. Business subscribers are responsible for ensuring their employees use the Platform in accordance with these Terms.
All payments are processed securely by Stripe. By subscribing, you authorise us to charge your nominated payment method at the applicable subscription rate on a recurring basis.
All prices are in Australian Dollars (AUD) and include GST where applicable.
We may change subscription pricing at any time. We will provide at least 30 days' notice of any price increase to active subscribers by email. Continued use of the Platform after the effective date constitutes acceptance of the new price.
This Platform is not covered by Medicare, private health insurance, or any government subsidy scheme. It is a self-funded wellbeing resource.
You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to the Platform until that date.
Cancelling your subscription retains your account and data for 90 days. If you wish to permanently deactivate your account and have your data deleted, please contact us at tttd@emotionalbalance.com.au. We will confirm deactivation and data deletion within 30 days.
We do not provide refunds for partially used subscription periods. If you experience a technical issue that prevents you from accessing the Platform, please contact us and we will work to resolve it promptly.
Nothing in these Terms limits your rights under the Australian Consumer Law, including any right to a remedy for a major failure of our service.
You agree to use the Platform only for lawful purposes and in a manner consistent with these Terms. You must not:
All content on the Platform including written resources, audio content, scripts, images, logos, and the Platform's design is owned by or licensed to Tools for the Tough Days and is protected by Australian and international copyright law.
Your subscription grants you a personal, non-transferable licence to access and use Platform content for your own private, non-commercial purposes only.
You must not reproduce, publish, modify, create derivative works from, or commercially exploit any Platform content without our prior written consent.
To the maximum extent permitted by law, Tools for the Tough Days and Nic Marcon will not be liable for any indirect, incidental, special, or consequential loss or damage arising from your use of the Platform, including (without limitation) loss of data, loss of profits, or any harm to your health or wellbeing.
Our total liability to you for any claim arising from use of the Platform will not exceed the amount you paid us in the three months preceding the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded under Australian law, including rights under the Australian Consumer Law.
The Platform is not a clinical service and does not create any duty of care beyond what applies to the provision of general educational information.
We aim to keep the Platform available at all times, but we do not guarantee uninterrupted access. The Platform may be unavailable during scheduled maintenance, technical outages, or events outside our control.
We will endeavour to provide advance notice of planned maintenance where possible.
The Platform integrates with third-party services including Stripe (payments), Vision6 (email), Microsoft Bookings (appointments), OneSignal (push notifications), and Google Analytics (usage data). Use of these services is subject to their respective terms and privacy policies.
We are not responsible for the terms, privacy practices, or content of third-party services.
We may update these Terms from time to time. We will notify active subscribers of material changes by email at least 14 days before they take effect.
The current version of these Terms will always be available on this page, with the "Last updated" date revised accordingly. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of Queensland, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of Queensland for any dispute arising from these Terms or your use of the Platform.
